WHAT IS DIVORCE?
A divorce, sometimes
called a decree of "dissolution of marriage", is a court order
terminating a marriage. It no longer exists. Unlike an annulment, which
states that the marriage never existed, a divorce is the termination of
a valid marriage.
Typically
in the divorce the parties and/or court resolve all issues between them,
such as division of property, child custody and visitation, and spousal
and child support.

Fault and
No Fault Grounds for Divorce
There are
two categories of grounds for divorce-fault and no-fault.
- A fault
ground places blame on one spouse for the end of the marriage. To get
divorced on fault grounds one spouse must prove that the other spouse
specifically did something to cause the end of the marriage; for example,
having an affair.
- A no-fault
ground does not place blame on either spouse for the end of the marriage.
WHAT IS DIVORCE MEDIATION?
Divorce mediation
is a process in which divorcing spouses try to negotiate an acceptable divorce
agreement with the help of a neutral third party -- the mediator. The mediator
helps the spouses to communicate and negotiate but doesn't make any decisions
for them.
