WHAT IS CHILD CUSTODY?
Child custody
is a term that refers to the bundle of rights and responsibilities that
a parent carries with respect to his/her child. Child custody includes numerous
concepts, some of which overlap and some that are distinct. The term child
custody can be further broken down into terms that shed additional light
and provide a greater understanding of the respective parents rights and
obligations with respect to their common child.
Legal custody - refers to the right of a parent to make decisions
about a child's upbringing. In some cases, joint legal custody is awarded
to both parents. In this instance, the parents of the child must make decisions
about the child's welfare together.
Physical custody - refers to the right of a parent to have a child
live with them. In some cases, joint physical custody is awarded.
Sole custody - when sole custody is awarded to one parent, that parent
has sole legal and physical custody of the child.
Joint custody - refers to joint physical custody, joint legal custody,
or both.
